When you visit and/or shop or purchase from Artmitul.Com, you accept the following conditions. Please read these terms and conditions carefully before you take a decision to purchase or make any business or financial transaction on the website.

For the purpose of these Terms of Use (“The Agreement”), whenever the context so requires “You” or “User” shall mean any natural or legal person who has agreed to become a buyer on Artmitul.Com either by providing registration data while registering on the website or by purchasing goods and products displayed on Artmitul.Com. The term “Artmitul.com”, “Us”, “We”, “Our”, “website” will mean Artmitul.Com, which is a division of The Dove & The Eagle.

You will use the service of this website only upon agreeing to enter into a binding contract in compliance with this Agreement and all applicable local, state, national and international laws, rules and regulations. All items purchased from Artmitul.Com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to You upon our delivery to the Shipper.

Product Descriptions

A majority of the products displayed on Artmitul.Com are hand crafted. These are unique products and, therefore, are not expected to have the same results as machine-made production. Most of these products will have the inconsistencies and irregularities that are part and parcel of hand-made production. While Artmitul.Com and its affiliates attempt to be as accurate as possible in product description, the website do not warrant that product descriptions or other content of this site are accurate, complete, reliable, current, or error-free. If a product offered by Artmitul.Com is not as described, your sole remedy is to return it in unused condition to the satisfaction of Artmitul.Com.

Pricing

Except where noted otherwise, the List Price displayed for products on our website, whether in Foreign Currency or Indian Rupees represents the full price of the product and international shipping charges, unless specified otherwise in the Shipping Fees.

However, given the hundreds of countries that we serve combined with the ever-changing regulatory norms and the nature of international shipping, in some cases a customer could be asked to pay additional import duties and taxes levied after a shipment reaches your country. A large majority of orders will not have to pay any additional fees. However, we are unable to calculate when and how much these infrequent customs duty charges will be levied. In the case where additional customs charges are levied, you will be responsible for paying these additional fees. It will be the responsibility of the shipper to custom clear your goods. If you are presented with an invoice from the shipper for import duties and taxes, you will have to pay the shipper directly at the time of delivery.

With respect to items sold on Artmitul.Com, if we charge your credit card/debit card before your order has entered the shipping process, and for any reason if we are unable to ship you products as per your order, we will intimate you electronically and refund the value of the products not available. Any additional Shipping Fees, if applicable, will not be refunded.

Despite our best efforts, a small number of the items in our catalogue may be mispriced. If we discover a mispricing, we will do one of the following:

If an item’s correct price is lower than our stated price, we will charge the lower amount and ship you the item.

If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

Because our website sells mostly handcrafted products, most of the items being unique and irreplaceable with an exactly similar one, in the event we discover any damage to Your purchased product prior to shipping, we will inform you and cancel the order and refund your entire money if you have paid for it.

Please note that the prices displayed on this website are quoted in the currency of Your residence or in specific International currencies where the local currency is not mentioned. Please note that the actual amount to be paid by you will be the equivalent amount in the currency of your credit card, as per the conversions done by your bank / credit card provider on the date of billing.

Shipping

All Artmitul orders are shipped door-to-door from our facility in Kolkata, to your provided shipping address via Shippers. Processing the order normally takes 2-4 working days and then Shipping normally takes 4-21 working days. If for any specific reason, shipping is delayed we will inform you with the reason of delay.

Shipping destinations offered by Artmitul.com for delivery will be extended and updated from time to time and listed online.

We do not ship backorders. We aim to keep every item on our website in stock. If there is an item which you purchase and then we realize this item is not available, we will promptly inform you within 2 working days of your purchase and fully refund your money for the out of stock item. In the event of cash on delivery (COD) purchase, we will inform you of the product unavailability and cancel the order. In COD there will be no refund as you have not paid us for the good your ordered.

Please note that we do not have the facility for COD for our international customers.

We can only process one shipping address per order. So, if you would like to order several items and ship to different people, please treat these as separate orders. We cannot ship to Post Office Box addresses and take no responsibility for non-delivery of orders in case the delivery address includes P. O. Box details in any part or form.

In case of COD orders, delivery to your registered address will be attempted only once whereas for online payment orders it is usually attempted twice depending on certain factors. The delivery attempts are based on the updates received and can change on a case to case basis.

You can track the package through the Order Tracking facility. If the package status is shown as undeliverable please call the Shipper at their Customer Care Service or their local number and quote your tracking number to trace your package.

In an exception case you can mail us within 24 hours to notify the courier company to re-attempt the delivery. As an exception and if the delivery is at a stage of transit of the shipment we will re-attempt delivery. Delivery Exception is a stage in the transit of the shipment where the shipment gets stuck due to some reason. There could be several reasons such as a wrong address, the customer was not available.

If you have provided a wrong or incomplete address for delivery and the delivery boy from the shipper gets in touch with you and you request for re-routing to a new address, there are additional charges which you will have to pay directly to the shipper upon delivery.

Please note that consignment rerouting can be done only within the particular hub under which the current delivery address exists.

 

RETURN & EXCHANGES

We strongly urge you to consider a few facts before you decide to return an Artmitul.Com product. Please understand that all our products are handcrafted in some way or the other. The irregularities in handcrafted products are what gives them their value, while some inconsistency is inherent to anything that are made by hands. And by the same token, while machine made items can be consistent and at time quite cliched, the inconsistencies of handmade products make them exciting and brilliant. We expect that when you purchase our products, you have considered these facts and have made an informed decision to purchase them. Majority of our products are unique and slightly different from the other.

In spite of these variables, at Artmitul we stand behind the quality of our products and we will replace the product free of cost if you claim that what you purchased turns out to have significant discrepancy to what is described at the website from what you received. Please read below our return & exchange policies before you return any item.

Reverse Pick Up Policy

We have a simple and yet efficient reverse pick-up policy for customers. Since we value our customers as part of our big family, we try our best keep our relation as sweet as it is at the time of sales, and subsequent stages of after sales or returns and refunds.

For return and re-funds, you must e-mail us at support@artmitul.net within 48 hours from the time of delivery with details of your item of purchase. Subsequent to that we will email you a standard blank application form, which you have to fill up and email us back at the above address. If we do not respond to your email within 72 hours, then you should get in touch with us at +91 8582875178 and we will advise you.

  • Please mention your order number in the subject line of the emails to help us quickly process your returns/exchanges.
  • Please ensure that the returned merchandize is unused, unworn, unwashed, undamaged or distorted like peeled colour from the surface of a product, etc., and is in a saleable condition.
  • We request you to maintain the original packaging of the items to be returned, including the Artmitul tags.
  • Please ensure that all the returned items are packed securely and safely to prevent any loss or damage during transit.
  • The items for reverse pick up will be picked up within 4-5 business days from the date of the approval of your request.
  • After the receipt of item(s), your request for returns/exchanges would be processed.
  • In the case of returns, banks normally take 7-10 business days to process a refund once it has been initiated from our end.
  • In the case of exchanges, your new order will be dispatched to you within 3-5 business days after we receive the earlier shipment.

Note: – Some of the pin codes are not feasible for Reverse pick up, in such cases the customer will need to send it back to us. Please note we do not offer reverse pick facility outside India.

Our shipments are carefully inspected before leaving our warehouse, but if you are not satisfied with your purchase, please follow the instructions below:

  • Artmitul will exchange the returned items free of cost or issue a refund for the cost of the goods to the credit/debit card used for online shopping.
  • Shipping charges will not be refunded and customers are required to pay for the shipping costs to return the goods to the applicable return address indicated on the Returns & Exchanges form if the pin code is out of pick up location
  • Please note that Exchange or Refund will not be made against the following items, unless there is material damage not resulting from shipping:

  • Saris
  • Stoles & Dupattas
  • Dresses
  • Jewellery
  • Giftware
  • String and sling bags
  • Ceramic and pottery Items
  • Wooden products and products made from combination of wood and other material
  • Paintings, both framed and without frames

Claiming Refunds

For Credit Card/Debit Card/Net banking or Paypal Transactions:

As the charge on your credit card / account would have already been done online at the time you made the purchase and authorized the payment, we will provide a refund into the original mode of payment.

If applicable, refunds would be made for the cost of the goods to the credit /debit card used for online shopping. However, shipping charges would not be refunded except where Artmitul has erroneously sent you a wrong item / colour / size.

For COD (Cash on Delivery) Transactions:

  • Refunds can only happen via Gift Vouchers.
  • Cash Refunds are not allowed for COD orders since we cannot get deliver cash through shippers.
  • Customer can also place a request for a reverse pick up in case reverse pick up service is available through our shippers.

Refunds will only be done in the following cases:

  • Genuine sizing issues, only for unused garments with tags. Please review our size guides carefully before making your purchase.
  • Genuine quality issues.
  • Packages lost in transit.
  • In case Artmitul discovers any mispricing in its online catalogue and the price charged to you is higher than the actual price.
  • In case Artmitul discovers that a wrong item has been shipped to you.
  • In case the customer is not happy with the purchase and has returned the item/items to the address mentioned above. In such cases the filled return form should be included in the return shipment.

No refunds will be given in the following cases:

  • In case of minor design and colour variations. With handloom products there will always be some variation between products.
  • Incorrect or outdated delivery address.
  • Incorrect address format including any form of a PO Box address.
  • After 2 failed delivery attempts by the shipper for online purchase and 1 attempt for COD purchase
  • Package refused by recipient.
  • Products returned in a used or damaged condition.

Note: Refunds will only be made after we have received the returned shipment except if the package has been lost in transit.

Product Properties And Wash Care

All of Artmitul’s products are handcrafted, using the natural resources, including natural fibres and woods, stones, metals or their derivatives. The subtle variations in colour, texture and finish are intrinsic to hand made products. Our products involve crafts-based traditions of hand cutting and painting, hand spinning, dying, weaving, wood block printing, embroidery, subliming using tools manually and so on. We use both vegetable dyes and commercial dyes with the goal of minimizing our impact on the environment while striving for the best colour properties. An irregular weave or print is not a defect – handloom by definition means uncertainty when it comes to uniformity; similarly, slight variation in texture or colour of natural stones in the same string of necklace or in a pair of earring is not an error in our workmanship, but it is inherent to handcrafted work on natural stones. This is true for all our products.

Colours: We have done our best to display as accurately as possible the colours of the products shown on this website. However, because the colours you see will depend on your monitor and resolution there could be slight variations, as we cannot guarantee that your monitor’s display of any colour will be accurate.

Reds and blues tend to run. Please always wash like colours together and dry inside out in the shade. All washable items in our product list should be either hand washed gently without the use of corrosive items or dusted and wiped gently with soft, clean clothes where these are not washable. Silks must ONLY be dry cleaned.

Disputes

Any dispute relating in any way to your visit to Artmitul.com or to products you purchase through Artmitul.com shall be submitted to confidential arbitration in Calcutta High Court, India, except that, to the extent you have in any manner violated or threatened to violate Artmitul.Com’s intellectual property rights, Artmitul.Com may seek injunctive or other appropriate relief in any court in India or internationally, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing under the Indian Arbitration Act. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

We reserve the right to make changes to our website, policies, and these Terms of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

BILLING & PAYMENTS

Artmitul enables online verification and authorisation of payments through two payment services: the EBS payment gateway, and through PayPal for all international (https://www.paypal.com). Artmitul.Com is a secured site with 128 bit SSL encryption.

  2. Credit Cards: Domestic and International Visa, MasterCard and American Express credit cards.
  3. Debit Cards: Debit cards issued by most of the major banks.
  4. Net banking: We allow net banking transactions from nearly 50 major Indian banks.

Note: Your billing amount will be shown in Indian Rupees on the payment gateway and in International currencies in Paypal purchasing from outside India. The price of products would vary from currency to currency, depending on which jurisdiction You are purchasing from. The variance of price is on account of various costs and duties, which are different from one geographic location to another.

International customers can pay from their PayPal account if they have a PayPal account. They can also choose to use their credit card to pay if they do not have a PayPal account. This option is not available to Indian residents as per RBI regulations.
